The Anti- Homosexuality Law that was tabled in 2009 and later signed into law in 2014 was one of the most draconian laws the world has ever seen in the 21st Century. The law was UnAfrican, Un constitutional and Anti-human rights. The Proponents of the law argued that there was need for stronger laws to curb homosexuality- (as if it was an epidemic), and to protect Children.
The law proposed criminalization of consensual same-sex relationships, criminalization of the work of advocates for LGBT rights and their allies, barbaric of all was a death penalty provision for aggravated homosexuality. From its inception, the law led to an unprecedented attack on the LGBT community in Uganda.
In 2014, the Civil Society Coalition on Human Rights and Constitutional law petitioned the Constitutional Court to repeal the law based on the human rights provisions within the constition. This Petition was the fundamental element upon which the constitutional court based their decision to declare the law null and void on a technicality.
Activists in Uganda, their partners and allies continue to emphasise the fact that the government has no business policing what consenting adults do in their bedrooms. Each individual has a right to decide what they can or cannot do with their bodies.
Criminalization of Homosexuality contravenes established International and Regional human rights standards, as well as the Constitution of the republic of Uganda. LGBT people are entitled to equality and non-discrimination and they need protection in the law, not criminalization by the law.
